These Terms of Use govern your access to and use of the Gulf Coast Estate Care website, mobile application, client portal, reports, notifications, and related online services.

1. Acceptance of Terms

By accessing or using the Gulf Coast Estate Care website, mobile application, client portal, reports, notifications, or related online services, you agree to these Terms of Use.

If you enter into a separate written or electronically signed service agreement with Gulf Coast Estate Care, LLC, that agreement governs the specific home watch, monitoring, access, vendor coordination, and related services provided for your property. In the event of a conflict between these Terms of Use and a signed service agreement, the signed service agreement controls with respect to services provided for the property, except where applicable law requires otherwise.

2. Company Information

The website, mobile application, and related services are operated by Gulf Coast Estate Care, LLC, a Florida limited liability company.

3. Website, App, and Portal Use

Gulf Coast Estate Care provides online tools that may allow clients to view property information, visit reports, photographs, notes, monitoring information, notifications, invoices, service updates, and related records.

You agree to use these systems only for lawful purposes and only in connection with your own account, property, or authorized business relationship with Gulf Coast Estate Care.

4. Account Access and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Gulf Coast Estate Care promptly if you believe your account, password, device, email account, or access credentials have been compromised.

Gulf Coast Estate Care may suspend or restrict access to online systems if we reasonably believe there is unauthorized use, misuse, security risk, non-payment, or violation of these Terms.

5. Service Information and Reports

Reports, photographs, videos, notes, observations, instrument measurements, monitoring data, audio recordings, AI-assisted transcriptions, and related service records may be made available through Gulf Coast Estate Care systems.

Such information reflects conditions observed, documented, reported, or measured at a particular point in time. Conditions at a property may arise, change, or worsen between visits or after documentation is created.

Online reports and service records are provided for client convenience and operational transparency. They are not a substitute for licensed inspections, engineering analysis, contractor evaluation, insurance review, security services, or professional advice from qualified third parties.

6. No Professional Trade or Inspection Services

Unless expressly agreed in a separate written agreement, Gulf Coast Estate Care does not act as a licensed contractor, engineer, electrician, plumber, mold assessor, pest control operator, insurance adjuster, security company, or property manager.

Home watch services are observational and non-invasive. Gulf Coast Estate Care does not guarantee detection of every issue, prevention of loss, uninterrupted monitoring, avoidance of damage, or performance by third parties.

7. Monitoring Devices and Alerts

If monitoring devices or related monitoring services are used, such services may depend on client-supplied power, client-supplied Wi-Fi internet connectivity, device battery condition, sensor placement, third-party platforms, cloud services, and other systems outside Gulf Coast Estate Care’s control.

Alerts, notifications, missing-report conditions, or monitoring data may be delayed, unavailable, inaccurate, interrupted, or not delivered. Gulf Coast Estate Care does not guarantee continuous monitoring, successful alert delivery, detection of every adverse condition, or prevention of damage.

8. Notifications

If you enable notifications, Gulf Coast Estate Care may send service-related alerts, visit confirmations, reminders, monitoring alerts, report availability notices, and updates related to your property or account.

Notifications may be affected by device settings, operating system behavior, internet connectivity, Apple Push Notification services, third-party systems, or other factors outside Gulf Coast Estate Care’s control. You may disable notifications through your device settings.

9. Vendor Coordination

Gulf Coast Estate Care may, at a client’s request, assist with practical coordination involving third-party vendors, including communicating observed conditions, coordinating access, meeting vendors at a property, or visually observing apparent completion of work.

Unless separately agreed in writing, Gulf Coast Estate Care does not hire, supervise, direct, warrant, pay, or control vendors. Clients contract directly with vendors and remain responsible for vendor selection, cost, approval, licensing, insurance, performance, workmanship, and outcomes.

10. Emergency Circumstances

Gulf Coast Estate Care may take reasonable, good-faith steps to observe, report, or help mitigate urgent conditions when authorized by a service agreement or client instruction. Emergency response may be limited by access, safety, weather, road conditions, vendor availability, communications, or other circumstances beyond Company control.

11. Privacy and Data Handling

Your use of Gulf Coast Estate Care systems is also governed by our Privacy Policy, which explains how we collect, use, store, process, retain, and protect information.

Gulf Coast Estate Care may use secure cloud-based systems and service providers to operate its website, mobile application, client portal, notifications, reporting, monitoring, storage, transcription, artificial intelligence, communication, and service-delivery systems.

12. AI and Automated Processing

Gulf Coast Estate Care may use artificial intelligence, automated transcription, machine-assisted tools, analytics systems, or related technologies to support service delivery, report generation, audio transcription, quality control, operational analysis, and administrative functions.

AI-assisted systems are used to support Company personnel and operational processes and are not intended to independently make decisions affecting legal rights, ownership, or occupancy of property.

13. Intellectual Property

The Gulf Coast Estate Care website, mobile application, reports, forms, templates, processes, text, graphics, logos, branding, workflows, and related materials are owned by Gulf Coast Estate Care or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, reverse engineer, scrape, or commercially exploit any portion of the website, app, client portal, reports, or related systems except as expressly authorized by Gulf Coast Estate Care.

14. Client Documentation

Documentation created in connection with services may include photographs, videos, visual documentation, audio recordings, voice notes, AI-assisted or manual transcriptions, written notes, observations, instrument readings, environmental measurements, monitoring-device telemetry, inspection reports, and related records.

Documentation is used for service delivery, inspection reporting, record-keeping, quality control, and documentation of observed conditions. Client-specific documentation will not be used for marketing, advertising, or unrelated commercial purposes without prior written consent.

15. Payment Links and Third-Party Services

Gulf Coast Estate Care may provide links to third-party services for payment processing, electronic signature, communication, maps, notifications, monitoring, or other operational functions. Your use of third-party services may be governed by their own terms and privacy policies.

Gulf Coast Estate Care is not responsible for the availability, performance, security, or policies of third-party systems outside its reasonable control.

16. Prohibited Uses

You agree not to:

  • Use the website, app, portal, or systems for unlawful, fraudulent, harmful, or abusive purposes
  • Attempt to access another client’s account, property information, reports, or data
  • Interfere with or disrupt Company systems, networks, security, or service operations
  • Upload malicious code, attempt unauthorized access, or bypass security controls
  • Misrepresent your identity, authority, property ownership, or authorization to act for a property owner
  • Copy, scrape, reverse engineer, or commercially exploit Company systems or content without authorization

17. Availability and Changes to Online Services

Gulf Coast Estate Care may update, modify, suspend, restrict, or discontinue website, app, portal, reporting, notification, or monitoring functionality at any time. Online services may be unavailable due to maintenance, outages, cybersecurity events, third-party service issues, internet disruptions, or other circumstances.

18. Disclaimers

The website, mobile application, client portal, reports, notifications, monitoring information, and related online services are provided on an “as is” and “as available” basis.

Gulf Coast Estate Care disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, completeness, or error-free performance, except where such disclaimers are prohibited by applicable law.

19. Limitation of Liability

To the maximum extent permitted by law, Gulf Coast Estate Care shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, or similar damages arising out of or relating to use of the website, mobile application, client portal, reports, notifications, monitoring systems, or related online services.

Any limitation of liability contained in a signed service agreement applies to services provided for the property covered by that agreement.

20. Security Limitations

Gulf Coast Estate Care uses commercially reasonable safeguards designed to protect information; however, no cloud platform, software system, storage provider, monitoring platform, network, or transmission method can be guaranteed completely secure or uninterrupted.

Except where prohibited by applicable law, Gulf Coast Estate Care shall not be liable for unauthorized access, cyberattack, data breach, interception, corruption, loss of data, service interruption, or other security-related incident arising from circumstances beyond Company’s reasonable control.

21. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Venue for disputes shall lie in the state courts located in Collier County, Florida, unless otherwise required by law or modified by a signed service agreement.

22. Changes to These Terms

Gulf Coast Estate Care may update these Terms from time to time. When we do, we will post the updated version on this page and revise the effective date above.
